Embryonic stem cells are actively debated in political and public policy arenas. However, the connections between stem cell innovation and overall health care policy are seldom elucidated. As with many controversial aspects of medical care, the stem cell debate bridges to a variety of social conversations beyond abortion. Some issues, such as translational medicine, commercialization, patient and public safety, health care spending, physician practice, and access to insurance and health care services, are core health policy concerns. Other issues, such as (...) economic development, technologic progress, fiscal politics, and tort reform, are only indirectly related to the health care system but are frequently seen through a health care lens. These connections will help determine whether the stem cell debate reaches a resolution, and what that resolution might be. (shrink)

American society tends to medicalize or criminalize social problems. Criminal justice reformers have made arguments for a positive role in the relief of poverty that are similar to those aired in healthcare today. The consequences of criminalizing poverty caution against its continued medicalization.

Medicine and health are surprisingly separate. In the introduction to his 1963 master work on medical economics, Kenneth Arrow acknowledged that “the subject is the medical-care industry, not health.” In the 50 years that followed, researchers, policymakers, and public health professionals generated valuable and varied insights into health, impacting both behaviors and environments while addressing social determinants and demographic trends. Yet medical care has followed an even steeper upward trajectory, growing rapidly in scientific precision, public esteem, and technical sophistication.As a (...) result, the economic gap between the two domains has widened. The U.S. health care system spends almost $3 trillion annually. Preventive screening and early intervention bridge medical care and health, as do nutrition, behavioral health, aging, and a few other fields. For the first time, entrepreneurs are aggressively developing new technologies and business models designed to improve individual and population health, not just to deliver specialized medical care. Consumers of these goods and services are not yet “patients”; they are simply people. As this sector of the health care industry expands, it is likely to require new forms of legal governance, which we term “upstream health law.”.

It is no exaggeration to say that American health policy is frequently subordinated to budgetary policies and procedures. The Affordable Care Act was undeniably ambitious, reaching health care services and underlying health as well as health insurance. Yet fiscal politics determined the ACA’s design and guided its implementation, as well as sometimes assisting and sometimes constraining efforts to repeal or replace it. In particular, the ACA’s vulnerability to litigation has been the price its drafters paid in exchange for fiscal-political acceptability. (...) Medical-legal partnership (MLP) embeds attorneys and paralegals into care delivery to help clinicians address root causes of health inequities. Notwithstanding decades of favorable outcomes, MLP is not as well-known as might be expected. In this essay, the authors explore ways in which strategic alignment of legal services with healthcare services in terms of professionalism, information collection and sharing, and financing might help the MLP movement become a more widespread, sustainable model for holistic care delivery.

Essays on stem cell policy seem to fall into three categories. Some essays in this collection are about logic and principles. Others are about practices and beliefs. The former group draws lines and defends them, a normative project. The latter group attempts to explain the lines that already exist, a descriptive project that may have important normative goals. Still other essays, by scientists, are about growing stem cell lines instead of drawing them.The purpose of this essay is to situate the (...) lines being drawn around stem cell science in the larger landscape of health policy. Tracing the evolution of political conversations about health care spending and their relationship to the formation of policy is a valuable exercise. Health care spending is about science and ethics, markets and government, freedom and community. By the late 1980s the unique upward trajectory of post-Medicare U.S. health care spending had been established, recessions and tax cuts were eroding federal and state budgets, and efforts to harness market forces to serve policy goals were accelerating. From the initial writings on “managed (...) competition,” through the failed Clinton health reform effort in the early 1990s, to the passage of the Affordable Care Act in 2010, the policy narrative of health spending acquired a superficial consistency. On closer examination, however, it becomes apparent that the cost problem has been repeatedly reframed in political discourse even during this relatively brief period. The clearest transition has been from a narrative centered on rationing necessary care to one committed to reducing wasteful care – although the role of accumulated law and regulation in perpetuating waste remains largely unrecognized and the recently articulated commitment to population health seems an imperfect proxy for explicitly developing social solidarity with respect to health and health care in the United States. There were two ways for the solicitor general of the United States to litigate the constitutional challenge to the Patient Protection and Affordable Care Act of 2010 brought by twenty‐six states and the National Federation of Independent Business. One path, which the solicitor general pursued, was to cautiously navigate judicial precedents, claim the barest increment of new congressional authority, and give the Supreme Court as many hooks as possible on which to hang a favorable decision.The road not traveled was to (...) offer a full‐throated defense of federal authority to comprehensively regulate the U.S. health care system, a multitrillion dollar commercial and social enterprise that represents the largest component of federal expenditure after national defense. The ACA has three cornerstones. First, make health insurance coverage as widespread as possible. Second, improve the quality and efficiency of health care delivery. Third, make individuals and communities healthier. The second and third pillars are sometimes overlooked because so much attention is paid to expanding coverage, but the hallmark of the ACA is that it combines major changes to health insurance, health care delivery, and health in a single piece of federal legislation.The Obama administration's timidity echoes what is strikingly absent from the new law. Although the ACA represents the successful culmination of a decades‐long struggle to universalize coverage, its structure and text never convey the intent that all Americans have a common stake in the health care system. African Sage Philosophy. The Sage Philosophy Project began in the mid-1970s at the Department of Philosophy of the University of Nairobi Kenya. At the University, Henry Odera Oruka (1944-1995) popularized the term “Sage Philosophy Project,” and closely related terms such as “philosophic sagacity,” both by initiating a project of interviewing African sages. This article presents the history of the project and its major accomplishments.

The paper explores the methodology and goals of H. Odera Oruka’s sage philosophy project. Oruka interviewed wise persons who were mostly illiterate and from the rural areas of Kenya to show that a long tradition of critical thinking and philosophizing exists in Africa, even if there is no written record. His descriptions of the role of the academic philosopher turned interviewer varied, emphasizing their refraining from imposition of their own views (the social science model), their adding their own ideas (...) (like Plato), or their midwifery in helping others give birth to their own ideas (like Socrates). The accuracy and consistency of the various metaphors used by Oruka is the main focus of the article’s analysis. The article sums up the shortcomings of Oruka’s method as well as its strengths and concludes with Oruka’s challenge to academic philosophers to rethink their own roles in society. (shrink)

This work explores an aspect of Yeats's writing largely ignored until now: namely, his wide-ranging absorption in S.T. Coleridge. Gibson explores the consistent and densely woven allusions to Coleridge in Yeats's prose and poetry, often in conjunction with other Romantic figures, arguing that the earlier poet provided him with both a model of philosopher - 'the sage' - and an interpretation of metaphysical ideas which were to have a resounding effect on his later poetry, and upon his rewriting of (...) This article traces the larger theme of egalitarianism within the context of equality of the sexes throughout H. Odera Oruka’s interviews with Kenyan sages, whom he asked to share their views on the topic. Often, the sages asserted men’s superiority to women. This paper analyses the sages’ responses, as well as Odera Oruka’s rejoinders to their comments. I have broadened my study to include five sages interviewed by Frederick Ochieng’-Odhiambo, included in his dissertation completed under Odera Oruka’s supervision (1994). I (...) find that the sages’ arguments for women’s inferiority were weak and flawed. Many contemporary Kenyans find fault with views similar to the sages’. The one sage who did elaborate on women’s equality failed to acknowledge that men discourage women from taking action to improve their situation. This article does not reject sage philosophy as an approach to the topic but insists that further study, including women sages, is needed to address the shortcomings of the sage interviews included in Odera Oruka’s Sage Philosophy (1991). An article by F. Ochieng'-Odhiambo asserted that Prof. H. Odera Oruka's work on "philosophic sagacity" in Kenya could be divided into three periods, beginning with an early period denouncing ethnophilosophy and ending with a later period which embraced and engaged in ethnophilosophy. This article says that such a characterization is inaccurate, because Odera Oruka continued to distinguish sage philosophy from ethnophilosophy in several key ways, even in his later work. While pointing out Odera Oruka's changing positions is a service (...) to scholars, Ochieng'-Odhiambo implicitly champions the early work at the expense of the latter. This article argues that folk sages were added to the later stages of the sage philosophy project with good reason, and that the project as it developed provided insights on ethical and socio-political issues as well as identity issues facing Kenyans. This book examines the possible ways in which the authors of the Synoptic Gospels, Mark, Matthew, and Luke, were inspired by philosophical traditions. It considers how the authors discussed Jesus in relation to contemporary philosophy.

Prof. H. Odera Oruka started the sage philosophy project, in which he interviewed wise elders in Kenyan rural areas to show that Africans could philosophize. He intended to create a “national culture” by drawing upon sages from different ethnic groups and he downplayed religious differences, as did Kwame Nkrumah, who had a similar goal of building “national culture” in Ghana. Both projects were secular insofar as they preferred to emphasize rationality and downplay religious belief or “superstition” as backward and (...) needing to be cast off. I deal with one apparent counter-example: at the burial trial for S. M. Otieno, Odera Oruka seemed to defend the traditional Luo belief of spirits. I note, however, that Odera Oruka is evasive and indirect in how he answers the questions and his responses could be due to his wanting to appear connected to his rural compatriots, a value explained by Frantz Fanon in his treatment of the topic of national culture. The paper concludes by alluding to extensive interviews done with the sages from Kenya on topics related to religious beliefs and practices, during which sages subject those beliefs and practices to rational scrutiny. Comparing the Bhagavad Gītā and the Buddhist essay “Prajñā is Not-knowing” (Panruo Wuzhi 般若無知) yields interesting insights. The texts have similar dialogical structures and discuss complex philosophical matters. Rhetorically, both texts weave together quotations and allusions from other texts, make liberal use of paradox, and have decidedly spiritual intentions. Their differences, though, remain striking. They emerge from distinct circumstances and their original languages (Sanskrit, Chinese) differ markedly. Stylistically, “Prajñā” is more intellectual and less devotional, espousing a distinctly “this worldly” ideal; (...) by contrast, the Gītā is more dramatic. While espousing “this worldly” ideals, the Gītā is more inclusive and thus more accessible to a broad audience; on the contrary, “Prajñā” has a subtler effect, its “dark” qualities appealing to a more select group. Therefore, while these texts are not “the same,” reading across their convergences and divergences can lead to a deeper understanding of mysticism and cross-cultural spirituality. (shrink)

In the last few years, several scholars have attempted to analyze the historical circumstances of Bhaṭṭoji Dīkṣita and the development of his specific stances in the area of Pāṇinian grammar. This paper seeks to broaden that investigation by exploring Bhaṭṭoji Dīkṣita’s relationship to Appayya Dīkṣita. Appayya Dīkṣita’s works, such as the Madhvatantramukhamardana, were the direct source of inspiration not only for the critique of the Mādhva Vedānta that appears in Bhaṭṭoji Dīkṣita’s Tantrādhikārinirṇaya and Tattvakaustubha. They may also be seen as (...) the ideological source for Bhaṭṭoji Dīkṣita’s grammatical fundamentalism, in rejecting any views that are not strictly in agreement with the views of the three founding sages of Sanskrit grammar, namely Pāṇini, Kātyāyana and Patañjali. Incorporating Martha Nussbaum's work on the “intelligence” of human emotions in Greco‐Roman moral philosophy, Robert Kaster's analysis of the “narrative scripts” of rivalrous emotions in antiquity, and René Girard's insights into the role of “mimetic desire” in human envy, this article explores the strategies of two major early Christian bishops, Cyprian and Basil of Caesarea, to “read” and to cure the variant scripts of envy and related invidious passions in concrete ecclesial contexts. The article also examines certain monastic theologians in (...) late antiquity who aspired to preempt invidious passions by encouraging salutary scripts of competition in virtue that realized equality of honor in their respective communities. S'il est très difficile de repérer et de juger les choix que le développement du système a inspirés aux Etats-Unis, il n'en est pas mains certain que ses résultats tangibles sant maigres car la masse des anciens programmes, principale source potentielle de moyens nouveaux, n'a guère été remise en question.La valeur (...) intrinsèque du PPBS ne peut être mise en cause. Ce qui doit l'être, c'est la lenteur de son développement, qui demeure peu avancé. Cette lenteur s'explique, car le système ne peut produire des fruits dans une terre stérile qu'on n'a pas préparée.La brutalité et les maladresses de l'opération déclenchée en 1965 dans le gouvernement fédéral américain ne pouvaient que renforcer la résistance au changement et retarder, sinon compromettre, le succès final. Les perspectives demeurent heureusement favorables, puisque la nouvelle administration ne semble pas décidée à faire machine arrière et que les Etats et Villes ont démarré sous de bien meilleurs auspices.La principale conclusion qu'imposent les expériences américaines est que toute juridiction intéressée par le PPBS doit impérativement développer, de la façon la plus générale, la volonté d'instaurer le système et s'assurer les moyens de le faire. C'est dire qu'il est peu sage d'engager la bataille sur tous les fronts à la fois : il faut tenter des percées. Mais c'est dire aussi combi en l'information et la formation sant essentielles. A cet égard, l'installation généralisée de certains éléments du système, à savoir la structure de programmes et le budget-programme, loin de présenter des inconvénients, peut constituer un excellent exercice en dehors de son utilité directe pour le preneur de décision. Het is niet makkelijk deze beslissingen op te sporen en te beoordelen welke in de Verenigde Staten getroffen werden onder invloed van de ontwikkeling van deze systeembenadering. Toch is het met vrij grote zekerheid te stellen dat de tastbare resultaten gering zijn omdat de veelheid aan oude programma's die tenslotte toch de voornaamste potentiële bronnen zijn van nieuwe middelen, nooit werden aangevochten.De intrinsieke waarde van PPBS kan daarom evenwel niet worden genegeerd. Wat wel dient aangeklaagd is de traagheid van zijn aanslepende ontwikkeling. Deze traagheid is te verklaren door het feit dat het systeem slechts vruchten kan afwerpen zo het ingeplant wordt in degelijk voorbereid terrein.De brutaliteit en de onhandigheden bij de operatie die in 1965 werd ingezet in het amerikaans federaal overheidsbestel konden niets anders dan de weerstand tegen de verandering versterken en afbreuk doen aan het uiteindelijk slagen van het systeem. Dit betekent tevens dat het weinig aan te bevelen is de strijd op alle fronten terzelvertijd aan te binden maar wel geleidelijk doorbraken te verwezenlijken. Dit brengt dan evenwel ook met zich dat informatie en vorming essentieel zijn bij deze strategie. In dit verband moet dan ook gezegd worden dat reeds het invoeren van sommige deelementen van het systeem, zoals de programmastructuur en het programmabudget, voor de beslisser nuttig kan zijn voor zijn persoonlijk inzicht en vorming.De te voeren actie dient nog slechts te worden toegespitst op het overtuigen van de verantwoordelijken. ABSTRACT The individual-community relationship has always been one of the most fundamental topics of social sciences. In sociology, this is known as the micro-macro relationship while in economics it refers to the processes, through which, individual actions lead to macroeconomic phenomena. Based on philosophical discourse and systems theory, many sociologists even use the term "emergence" in their understanding of micro-macro relationship, which refers to collective phenomena that are created by the cooperation of individuals, but cannot be reduced to individual actions. (...) "Emergence" theories attempt to explain the nature of society as a complex system by examining how individuals and their relationships lead to the creation of integrated and macro-social phenomena such as markets, educational systems, cultural beliefs, and shared social practices. As a prelude to activity, every researcher has to answer the question from the methodological point of view, how is it possible to study the behavior of social groups and how can we gain knowledge about the laws related to social groups? Anyone who deals with humanities and social sciences or any reality and phenomenon that affects human beings, inevitably deals with the reality that is emerging. In fact, emergence occurs when one level of reality emerges radically from another level. Examples of emergent levels of reality include how the mind emerges from the body; or the way society emerges from human beings. Therefore, when there is an emerging factor, different scientific disciplines should be used, because it is inevitable to talk about social affairs, psychology and neurobiology, as well as physical and even chemical. -/- INTRODUCTION Since its beginning in the 19th century, sociology has faced the fundamental question of what a social phenomena stands for? At a glance, sociologists deal with the study of social groups, collective behavior, institutions, social structures, social networks, and social dynamics, and ultimately all such phenomena are composed of individuals. Therefore, social phenomena seem to have no independent ontological status, and in this case, sociology is ultimately about reducible individuals. Different approaches about the micro-macro relationship, using the concept of "emergence", argue that although collective phenomena are created by individuals, they cannot be reduced to individual action. The term "emergence" is used to distinguish "emergent results" from " Procedural results". Results are called Procedural that can only be calculated by adding or subtracting the causes that act together. On the contrary, they are emergent outcomes that are qualitatively novel compared to the causes from which they originate. An example of such emergent results is mental characteristics that emerge from neural processes, but are not considered among the characteristics of neural processes of components - which are their origin. Philosophical debates about emergentism and reductionism focus on the mind-brain relationship, but as many philosophers have noted, they can be generalized to apply to any hierarchical set of features. The cognitive revolution reactivated a 19th century controversy between theorists of Identity and dualism. The theorists of Identity believe in reductionist materialism and elimination of metaphysics, according to which the mind is nothing more than the biological, while the dualists believe that the mind and the brain are distinct from each other. Emergence has been considered as a third way between the theories of Identity and dualism. -/- METHODOLOGY Interdisciplinarity Is fundamentally indicated by the dominance of open systems as well as social and emerging systems at different levels. Therefore, as long as we are facing a new emergentism, there will necessarily be different fields and an interdisciplinary method. The commonality of social sciences and cognitive sciences on the issue of emergence provides the possibility of interaction and exchange of concepts between these two for deeper research. Therefore, in this research, apart from the concepts of Subvenience and downward causation, we have used multiple realization and wildly disjunctive, which are used to explain the emerging concept in cognitive sciences, including neurobiology, psychology, and philosophy. For analytical and interdisciplinary approaches, after examining the concepts of subvenience, and wildly disjunctive, Individualistic and collectivist emergentism have been reviewed. And then their adequacy is criticized and evaluated in meeting strong emergence conditions. -/- FINDINGS Philosophers of the mind have been able to define the conditions of irreducibility and downward causation, which are essential for strong emergence, by using the principle of subvenience with the help of multiple realization and wildly disjunctive principles. Therefore, by definition, emergentist individualism suffers from the problem of how to explain downward causality and irreducibility, and emergentist collectivism faces the challenge of reification. The analysis of the challenges facing the two methodological approaches of individualism and collectivism leads us to three unresolved issues about the emerging phenomenon, which are realism, downward causality, and mechanism. Despite the differences in the stances of these two approaches regarding the aforementioned triple problems, individualists and collectivists both agree that some social characteristics are reducible; and some others are irreducible due to their complexity, the determination of which, depends on the case study of the mechanism of emergence of each social characteristic. -/- CONCLUSION An emergence that is consistent with reductionism is called a weak emergence. And strong emergence includes the principle of irreducibility and downward causality. According to strong emergence, the characteristics of social phenomena have downward causal power, which cannot be reduced to the causal forces. The principle of subvenience, together with multiple realization and wildly disjunctive, can provide the conditions of irreducibility and downward causality, which are essential conditions of strong emergence. Based on the philosophical analysis of two methodological approaches, individualist and collectivist, it can be concluded that emergentist individualism suffers from the problem of how to explain downward causality and irreducibility, and reification collectivism faces the challenge of reification. The analysis of the problems faced by these two approaches leads us to three unresolved issues, which are realism, downward causality, and mechanism. individualist emergentists acknowledge the existence of emergent social characteristics, but despite this, they believe that these characteristics are not real but merely analytical constructs that require explanation based on individuals and their mutual actions. But collectivists argue that emergentism yields a categorical ontology and supports social realism. They accept the dependence of social characteristics on individuals, but claim that social entities and structures are ontologically independent. Individualists and collectivists both agree that some social characteristics are reducible; and others are irreducible due to their complexity; and the only way to recognize this is to engage in empirical studies of the mechanisms and temporal processes of "emergence" that create social characteristics. -/- NOVELTY The newness of this compact article is as follows: a) Presenting an interdisciplinary approach using the analysis of philosophy of cognitive sciences, including the philosophy of mind, neurobiology and psychology to formulate the issue of social emergence; b) Criticizing individualist and collectivist methodological approaches to the issue of social emergence and explaining the sufficiency and shortcomings of both in providing weak and strong emerging conditions; c) Explaining and categorizing the challenges facing methodological approaches in explaining the phenomenon of social emergence, in three categories: realism, downward causality, and mechanism. The article follows the theme of dealing with adversaries and conflict resolution. As an exercise in intercultural philosophy, the paper explores the philosophies of two different regions, the Amazon of South America (Jivaro and Yanesha/Amuesha people of Peru) and Western Province of Kenya, East Africa (with a focus on the Bukusu people). Exploring the insights of other researchers as well as drawing upon interviews by the author, the article explains each group’s philosophy of conflict resolution referencing myths, folktales, proverbs, and (...) interviews with sages. In the case of both communities, practitioners of peace must engage in bravery to reach out to others and address them with a message of peaceful relations. The Yanesha have a founding myth that emphasizes the role of a woman in establishing harmonious relations, whereas the Bukusu folktales emphasize men’s leadership. (shrink)

Twenty-five papers presented at University of Nairobi in 2000 cover themes of: African Philosophy, Approaches and Methodologies; Problems of Missionary and Colonialist Thinking; Gender and Culture in Africa; Sage Philosophy; and Philosophy, Ethics, and Politics.

The editors tell us this book is an outgrowth of their course in philosophical arguments. It contains both readings from traditional sources, and new material especially for this book. It is thus of interest as a potential text, as a source book, and for its original contributions. To consider it first as a text, it would be a challenging and valuable choice for sophisticated students. As a source-book, it is a good anthology of hard-core arguments on seven metaphysical topics. Authors (...) selected include Aristotle, Plato, Church Fathers, Rationalists, Locke and Hume, Bradley and Moore, Kant, Frege, Carnap, C. I. Lewis, Russell, and others. Selections run from a page or two to 16-page Hume excerpts. The last section, on The Nature of Metaphysics, contains essays newly written for this volume by A. J. Ayer, Brand Blanshard, John Passmore, and M. Lazerowitz. Other new material elsewhere in the book includes Alice Ambrose on Wittgenstein, and the introduction by W. E. Kennick. The latter suggests that in metaphysics there are arguments but no proofs, and that metaphysics has four curious characteristics: its disputes are never resolved; in these disputes the array of experts on each side is likely to be equally impressive; antinomies seem unavoidable; and metaphysics frequently conflicts with common sense. Ayer's article is called "Metaphysics and Common Sense." Using Carnap's distinction of "internal" and "external" questions, he finds metaphysical questions to be external. His explanation of what these are and why anyone would wish to raise them yields three legitimate ways in which metaphysics can add to our understanding of the world, and concludes that "it would be a mistake to forego the more imaginative kinds of conceptual exploration." In both tone and content this essay is a surprise for readers who know earlier work by Ayer. Passmore attempts to correct the popular tendency to confuse the philosopher with the sage. He places metaphysics, mathematics, and empirical science within "rational discussion": each is speculation, each has its characteristic control procedure. Blanshard's article attempts to defend metaphysics against criticisms such as those made by Dewey, Wittgenstein, and Freud.
